Joint Managing Conservators

The Texas Family Code states that there is a presumption by appointment the parents of a child as Joint Managing Conservators, it is in the best interest of the child. This means both parents are determined as co-equal with similar rights, responsibilities, and duties.

Primary Possession of the Child

The main battle is usually over which parent is designated in Primary Possession of the child. This parent is typically the one who receives child support payments, can claim the child on their taxes, and determines which school to attend. However, some extreme cases can differ.
