Custody Definition

Custody modification is a misnomer. Modification is generally sought for an alteration of conservatorship, possession of, and/or access to a child.

Modification & The Court

All modifications are subject to the court that entered the prior order, unless the child’s residency has changed, then a new court will rule on the modification.

Eligibility

In most cases, the petitioner needs to plead and prove that the circumstances of the child affected by the custody order have substantially changed since the prior order.

Child’s Choice

If a child is 12 years or older, they can voice their choice of parent who they wish to live with, and the prior custody order can be modified without showing a substantial change in circumstances.

Once the Modification is Filed

While the modification suit is pending, the court may not render a temporary order that changes the designation of the parent who has the right to choose the primary residence of the child unless:

  • Poor Living Arrangement

    The temporary order is necessary because the child’s current living arrangement may endanger their physical, mental, or emotional wellbeing

  • Voluntary Relinquish of Rights

    The parent who has the right to choose the primary residence of the child has voluntarily relinquished their rights for more than six months and the order is in the best interest of the child

  • Child’s Right to Choose

    The child is 12 years or older and has notified the court of their preference of parent and residence and is in the best interest of the child
